'Opting in' or 'out' of WTD 48 hours

In 2004 when the conduct regulations were enforced, the ‘opt out’ provision was introduced to give an option to those contractors who may not want to be ‘protected’.  If, for example, you are working through a limited company, then you should be provided with a form to sign on whether you wish to ‘opt in’ or ‘opt out’. To prevent the ‘opt out’ being invalid, this form must be completed and signed before introducing the contractor to the client.

There are various pros and cons of opting in or out that should be considered. A full guide on how to ‘opt out’ can be found here.
